What is a lode claim?
Lode claims are staked on veins or lodes of quartz or other rock in place bearing gold, silver, cinnabar, lead, tin, copper, or other valuable deposits. Placer claims are staked on all forms of depos- it, excepting veins of quartz, or other rock in place.
Are mining claims real property?
Yes – An unpatented mining claim is a unique form of property. Your right to the property is restricted to exploration, development and extraction of a mineral deposit at the site.
Can I placer mine on a lode claim?
No it is not online at this time. I remember hearing that once a Lode mine has been claimed, a placer cannot be placed overtop of its boundaries, as where-in, lode mines are allowed to be claimed within an already designated placer mine.
Can I build a home on a mining claim?
You may not construct, place, or maintain any kind of building or other structure, road, trail, fence or enclosure, and place or store equipment without the prior approval of a plan of operation from the Forest Service. Prospecting and exploration activities usually do not justify the use of such structures.
What is the size of a lode claim?
1,500 feet
Federal statute limits a lode claim to a maximum of 1,500 feet in length along the vein or lode. Their width is a maximum of 600 feet, 300 feet on either side of the centerline of the vein or lode. The end lines of the lode claim must be parallel to qualify for underground extralateral rights.
Can you build a house on a patented mining claim?
A patented claim gives the miner the right to both the minerals and the land itself. If the government approves a patent request, it transfers property title to the miner. At that point, the miner can explore, extract the minerals or build permanent mining structures and a home.
Can you put a cabin on a mining claim?
Virtually all unpatented federal mining claims are in multi-use areas, this means that anyone can camp on the area. The claim owner only has rights to the minerals which means the campers are not allowed to access minerals, they also can not stop the miners from mining.
When you buy a mining claim Do you own the land?
When you own a mining claim, you have purchased the exclusive rights to mine the minerals on that land, but you are not purchasing real estate. The land itself is not yours. You cannot put up “No Trespassing” signs.
